Terms of Use & Privacy Policy
This page contains the Terms of Use and Privacy Policy governing lamarchebaseball.com and all related products and services, including but not limited to online courses, individual modules, bundles, video reviews, one-on-one calls, and monthly coaching subscriptions (collectively, the "Services"). The Services are provided by William LaMarche, an individual doing business as LaMarche Baseball, located in California ("LaMarche Baseball," "I," "me," or "my"). "You" and "your" refer to any person who accesses the website, creates an account, or purchases or uses any of the Services, and, where the player is a minor, the parent or legal guardian acting on the player's behalf.
By accessing the website, creating an account, completing a purchase, submitting a video or form, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and this Privacy Policy in their entirety. If you do not agree, do not use the Services.
PART ONE: TERMS OF USE
1. Eligibility and Accounts
You must be at least 18 years of age, or the age of majority in your jurisdiction, to purchase Services or create an account. If the player is under 18, a parent or legal guardian must make the purchase, create and manage the account, and accept these terms on the player's behalf, and the parent or guardian is responsible for the player's use of the Services. You agree to provide accurate and complete information and to keep your login credentials confidential. You are responsible for all activity that occurs under your account.
2. License and Permitted Use
Upon purchase, you are granted a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and view purchased course content for your own personal, non-commercial use, subject to these terms. Each account is for use by one individual player only. You may not, and may not permit anyone else to:
- share, sell, rent, lend, or transfer your login credentials or account access;
- copy, download, record, screen-capture, reproduce, distribute, publish, broadcast, or publicly display any course videos, materials, worksheets, or other content;
- use any content to create derivative works, teach group classes, or provide paid instruction to others;
- circumvent, disable, or interfere with any access restrictions or security features of the website.
I reserve the right to suspend or terminate, without refund, any account that I reasonably believe is being shared or used in violation of these terms.
3. Pricing, Payment, and Member Pricing
All prices are listed in U.S. dollars and may change at any time without notice; changes will not affect orders already completed. Member pricing is available only to verified owners of the applicable course and may be changed or discontinued at any time. Discount and promotional codes are limited to one use per customer, may be restricted to specific products, have no cash value, cannot be combined unless stated, and may be revoked if misused. Payments are processed by third-party providers; by purchasing, you authorize the charge to your chosen payment method.
4. All Sales Final; No Refunds
All sales are final. Because digital course content is made available immediately upon purchase, and because video reviews, calls, and coaching are personal services reserved specifically for you, no refunds, credits, or exchanges are provided for any purchase, in whole or in part, for any reason, including but not limited to non-use, partial use, change of mind, scheduling conflicts, dissatisfaction with results, or loss of interest.
If you experience a technical issue that prevents you from accessing purchased content, contact me and I will make reasonable efforts to resolve it.
5. Payment Disputes and Chargebacks
You agree to contact me at info@lamarchebaseball.com and allow a reasonable opportunity to resolve any billing concern before initiating a dispute or chargeback with your bank or card issuer. Initiating a chargeback for a purchase you received in accordance with these terms may result in immediate suspension of your account and all associated access. I reserve the right to provide records of your purchase, account activity, content access, submissions, and these terms to your payment provider in response to any dispute.
6. Subscriptions (Monthly Coaching)
- Coaching subscriptions renew automatically at the end of each billing period (monthly or every three months, depending on the plan selected) and your payment method will be charged the then-current rate until you cancel.
- You may cancel at any time through your account. Cancellation stops future renewals; you will retain access through the end of the period already paid, and no partial or prorated refunds are provided.
- Each billing month includes the stated number of video reviews and calls. Unused reviews or calls expire at the end of each month and do not roll over, accumulate, or convert to credit.
- If a renewal payment fails, access may be paused or canceled until payment is completed.
7. Video Reviews
Video reviews are based solely on the footage and information you submit. Feedback quality depends on video clarity, angle, and completeness; I am not responsible for limitations caused by poor-quality, incomplete, or improperly filmed submissions. Reviews are delivered electronically to the email address you provide; you are responsible for providing a correct email address and checking spam or junk folders. Submissions outside the scope of a purchased review (for example, additional clips beyond the stated limit) may be declined or require an additional purchase. No specific delivery time is guaranteed.
8. One-on-One Calls
Calls are conducted remotely via video conference for the stated length. Scheduling is subject to availability and is confirmed only when I send a calendar confirmation. Please join on time; calls begin and end at the scheduled time regardless of late arrival. A call missed or canceled with less than 24 hours' notice may be forfeited and not rescheduled, at my discretion. I am not responsible for connection problems on your end.
9. Health, Safety, and Assumption of Risk
The Services are educational and informational only and do not constitute medical, physical therapy, or professional health advice.
Pitching and throwing are physically demanding activities that carry inherent risks, including but not limited to muscle strain, joint injury, ligament and tendon injury (including injuries requiring surgery), and other physical harm. Any references to injuries, rehabilitation, or recovery, including my own personal experience, are shared for educational purposes only and are not recommendations for your situation. You should consult a qualified physician, physical therapist, or other licensed professional before beginning any throwing program, training routine, mechanical change, or return-to-throw progression, particularly if you have pain, a prior injury, or a medical condition.
By using the Services, you voluntarily assume all risks associated with any physical activity you undertake, and you agree that you are solely responsible for determining whether any instruction is appropriate for you or your player. Players under 18 should train only with the knowledge and supervision of a parent or guardian and, where applicable, their coaches and medical providers.
10. No Guarantee of Results
Results vary from player to player and depend on many factors outside my control, including age, physical development, effort, consistency, health, coaching, and natural ability. Any testimonials, examples, or personal experiences (including velocity changes) are not typical or guaranteed outcomes. I make no promise or guarantee of any specific result, including increased velocity, improved performance, injury prevention, playing time, roster selection, recruitment, scholarships, or professional opportunities.
11. Intellectual Property
All content on the website and within the Services, including videos, text, graphics, frameworks, terminology, logos, and the LaMarche Baseball name and trademark, is owned by or licensed to me and is protected by copyright, trademark, and other laws. Nothing in these terms transfers ownership of any content to you. Videos and information you submit remain yours; you grant me a limited license to view, store, and analyze them solely for the purpose of providing your purchased Services.
12. Disclaimer of Warranties
The Services and all content are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. I do not warrant that the website or Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
13. Limitation of Liability
To the fullest extent permitted by law, LaMarche Baseball and William LaMarche shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any personal injury, lost opportunities, or loss of data, arising out of or related to your use of or inability to use the Services, even if advised of the possibility of such damages. My total liability for any claim arising out of or relating to the Services shall not exceed the amount you paid for the specific Service giving rise to the claim.
14. Indemnification
You agree to indemnify and hold harmless LaMarche Baseball and William LaMarche from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these terms, your physical activities, or, where applicable, the activities of the minor player on whose behalf you act.
15. Third-Party Services and Links
The Services rely on third-party platforms (such as website hosting, payment processing, file upload, video hosting, scheduling, and video conferencing providers). I am not responsible for the availability, performance, security, or policies of those third parties, and your use of them may be subject to their own terms.
16. Changes, Interruptions, and Discontinuation
I may modify, update, add, or remove any content, product, price, or feature, or discontinue any part of the Services, at any time. Course access is provided for as long as the course is offered on the website and is not guaranteed to be lifetime or perpetual. I am not liable for delays or failures caused by events beyond my reasonable control, including outages, illness, natural disasters, or third-party service failures.
17. Disputes and Governing Law
These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Before filing any claim, you agree to first contact me and attempt to resolve the matter informally for at least 30 days. Any dispute that cannot be resolved informally shall be brought exclusively in the small claims court or state courts located in Alameda County, California, and you consent to the jurisdiction of those courts.
18. General
If any provision of these terms is found unenforceable, the remaining provisions will remain in full effect. My failure to enforce any provision is not a waiver of that provision. These terms, together with any instructions provided at the point of purchase, constitute the entire agreement between you and me regarding the Services. You may not assign your rights under these terms. I may update these terms at any time by posting a revised version on this page; continued use of the Services after an update constitutes acceptance of the revised terms.
